June 16, 2008
The Regular Session of the 48th Council of the Municipality of the District of Shelburne was held on Monday, June 16, 2008 commencing at 6:00 p.m. in the Council Chambers of the Municipal Administration Building, Shelburne, Nova Scotia.

The Regular Session of Council was called to order at 6:00 p.m.

Councillor Raymond Davis led Council in repeating the Lord's Prayer.

BE IT RESOLVED that the Council Minutes of May 26, 2008 be approved as circulated.

TOWN OF LOCKEPORT – LETTER OF SUPPORT
On a Motion of Deputy Warden Pat Nickerson and Councillor Raymond Davis:
BE IT RESOLVED that Council support the request by the Town of Lockeport for a letter of support for their application to the Atlantic Canada Opportunities Agency for tourism infrastructure in the Town of Lockeport.
- MOTION CARRIED
Discussion was held regarding contributions to Lockeport Loop and it was clarified this issue requires no financial commitment.
9. (b) MOTION: BIZ PAL
On a Motion of Councillor Paulette Scott and Councillor Ardith VanBuskirk:
BE IT RESOLVED that the Council of the Municipality of the District of Shelburne execute an agreement with the Province of Nova Scotia to join Biz Pal.

Discussion was held regarding the benefits Biz Pal would bring to the Municipality in relation to new businesses being aware of the permits and forms that are required. It was noted that this initiative is free to all municipal units.
9. (c) MOTION: LEVY ON PACKAGING
On a Motion of Councillor Raymond Davis and Councillor Paulette Scott:
BE IT RESOLVED that the Municipality of the District of Shelburne write a letter to the MLA and Minister of Environment to support the issue of levy on quick service packaging or any form thereof (ie coffee cups).

Discussion was held regarding Region 6 lobbying for support on this issue as well as the levy offsetting clean up of these items.
9. (d) MOTION: GARBAGE COLLECTION: WEEKLY ORGANICS
On a Motion of Councillor Ardith VanBuskirk and Councillor Paulette Scott:
BE IT RESOLVED that the Municipality of the District of Shelburne continue with bi-weekly pick-up only.

Discussion was held regarding costs related to weekly pick up, municipal bin clean up, compost odour and education for residents. It was noted that the majority of municipal units continue with bi-weekly pick up during the summer months.
8. (a) MOTION: MOVE INTO PUBLIC HEARING
On a Motion of Councillor Raymond Davis and Councillor Paulette Scott:
BE IT RESOLVED that Council move into Public Hearing.
- MOTION CARRIED
Dudley Stewart, By-Law Enforcement Office informed Council of a Dangerous and Unsightly Premises located at 654 Woodlawn Drive. No one from the public was in attendance to address this matter.
MOTION: ADJOURN PUBLIC HEARING
On a Motion of Deputy Warden Pat Nickerson and Councillor Paulette Scott:
BE IT RESOLVED that Council adjourn the Public Hearing.

MOTION: DANGEROUS AND UNSIGHTLY PREMISES – 654 WOODLAWN DRIVE
On a Motion of Councillor Raymond Davis and Councillor Ardith VanBuskirk:
BE IT RESOLVED that the Council of the Municipality of the District of Shelburne direct staff to get prices on clean up of the Dangerous and Unsightly Premises at 654 Woodlawn Drive.

9. (e) MOTION: SHARED SERVICES LOGO
On a Motion of Councillor Raymond Davis and Councillor John Roscoe:
BE IT RESOLVED that the logo as depicted in the attached pictures be accepted as the logo for the Shared Services operations and be displayed on all motorized equipment.

Disucussion was held regarding Shared Services needing an identity.
9. (f) MOTION: SHELBURNE COUNTY RECREATION SOCIETY LETTER OF SUPPORT REQUEST
On a Motion of Councillor Paulette Scott and Councillor Ardith VanBuskirk:
BE IT RESOLVED that Council support the request of the Shelburne County Recreation Society by providing a letter of support, in principle, for the development of a recreation complex for the County that will include an indoor swimming pool.

9. (g) MOTION: LLO8 – YEAR TWO FUNDING
On a Motion of Councillor Raymond Davis and Councillor Ardith VanBuskirk:
BE IT RESOLVED that Council support the LL08 Society by providing year two funding of $2,500.00 from S23 account #0028340000.

9. (h) MOTION: DIGBY-ST. JOHN FERRY MARKETING PLAN
On a Motion of Councillor Raymond Davis and Deputy Warden Pat Nickerson:
BE IT RESOLVED that:

Council support the request for a financial contribution of $1,292.00 as our share of a $40,000.00 regional tourism campaign; funds to be taken from Grants to Organizations – Account number 0021950791. |
| 2) |
Municipality of the District of Shelburne write letters of support to appropriate political leaders in the provincial and federal governments for continued ferry service from Digby to St. John. |
| 3) |
Council suggest to the working group that they pursue federal funding from the Building Canada Major Projects Program. |

10. (a) MOTION: INDIAN FIELDS – POWER ISSUE
On a Motion of Deputy Warden Pat Nickerson and Councillor Raymond Davis:
BE IT RESOLVED that on the recommendation of the Committee of the Whole, the Council of the Municipality of the District of Shelburne direct staff to write a motion for the Fall UNSM Conference regarding the power problem in Indian Fields, and that we also write the Premier and the two opposition leaders, copied to the MLA.
- MOTION CARRIED
Deputy Warden Nickerson advised that the deadline for motions is June 30, 2008. Staff advised that it will be sent directly to UNSM as soon as possible.
8. (b) MOTION: MOVE INTO PUBLIC HEARING
On a Motion of Deputy Warden Pat Nickerson and Councillor Paulette Scott:
BE IT RESOLVED that Council move into Public Hearing.

Dudley Stewart, By-Law Enforcement Office informed Council of a Dangerous and Unsightly Premises located at 787 Woodlawn Drive. It was agreed that Mr. Stewart ensure the proper process is followed when contacting the representative for the estate of the property owner. The CAO will check with the Municipal Solicitor regarding estate matters.

BE IT RESOLVED that Council adjourn the Public Hearing.

MOTION: DANGEROUS AND UNSIGHTLY PREMISES – 787 WOODLAWN DRIVE
On a Motion of Councillor Raymond Davis and Deputy Warden Pat Nickerson:
BE IT RESOLVED that the Council of the Municipality of the District of Shelburne direct staff to contact the estate representative and follow due legal process as well as get prices from three contractors on clean up of the Dangerous and Unsightly Premises at 787 Woodlawn Drive.

(a) Monthly Building Report - May, 2008
(b) SRHS Smoking
13. (a)
The Monthly Building Report for May 2008 was reviewed by Council.
13. (b)
Discussion was held regarding options for smoking and littering on the sidewalk at SRHS, including vandalism proof disposal amenities as well as contacting the Department of Transportation and the Tri-County Regional School Board to discuss this issue.
Discussion was held regarding the crosswalk at Spa Road and King Street Intersection for the SRHS students including cost sharing with the Town of Shelburne, liability, insurance as well as signage, lighting and safety. A staff report will follow on this issue.
