REGULAR SESSION OF THE 49TH COUNCIL

OF THE

MUNICIPALITY OF THE DISTRICT OF SHELBURNE

April 27, 2009

The Regular Session of the 49th Council of the Municipality of the District of Shelburne was held on Monday, April 27, 2009 commencing at 5:00 p.m. in the Council Chambers of the Municipal Administration Building, Shelburne, Nova Scotia.

1. CALL TO ORDER:

The Regular Session of Council was called to order at 5:02 p.m.

2. BLESSING:

Warden Embree led Council in repeating the Lord's Prayer.

3. PROCLAMATIONS:

(a) VON Week – May 17-23, 2009

3. (a)

The Warden proclaimed the week of May 17 – 23, 2009 VON Week.

4. APPROVAL OF MINUTES - March 23, 2009

Being duly moved and seconded, be it resolved that the Council Minutes of March 23, 2009 be approved as circulated.

-MOTION CARRIED

5. APPROVAL OF AGENDA

Being duly moved and seconded, be it resolved that the Council Agenda of April 27, 2009 be approved with the following addition:

  • Municipal Building Emergency Upgrades

6. PRESENTATIONS:

None

7. BUSINESS ARISING FROM THE MINUTES:
  1. It was stated that Nova Scotia Power Inc. has limbed up the tops of a number of the trees near power lines along East Jordan to Lockeport, but noted that they should be cut back further or removed. It was suggested that this item be mentioned in the next correspondence to NSPI.

9(a)

MOTION: MUNICIPAL VEHICLE POLICY

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Municipal Vehicle Policy which states that:

Council accept the revised Municipal Vehicle Policy.

-MOTION CARRIED

It was noted that major repairs over the amount of $500.00 shall be approved by the CAO.

9. (b)

MOTION: SEWAGE TREATMENT SERVICING OPTIONS FOR THE SHELBURNE INDUSTRIAL PARK

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Sewage Treatment Options for the Shelburne Industrial Park, which states that:

  1. The Municipality of the District of Shelburne submit the sewage plant proposal as the number one priority for the Building Canada Fund;
  2. Staff work with officials at the provincial and federal governments to pursue funding for a new Sewage Treatment Plant (option 3) with a total project cost of one million dollars.
  3. Staff reduce the financial exposure of the Municipality of the District of Shelburne to a maximum of $350,000.00.

The CAO advised that the application deadline was April 17, 2009, he stated that staff provided an application and proposal and has since received confirmation of consideration.

Discussion was held regarding Council approving the final project parameters and costs at a later date, budget considerations and collaboration with the Town of Shelburne as well as various funding opportunities to minimize the Municipality’s cost.

9. (c)

MOTION: COMMUNITY GARDEN PROJECT

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Community Garden Project, which states that:

  1. The Municipality of the District of Shelburne support the community garden project at Shelburne Regional High School (SRHS) by helping to engage the community, promote the project and provide opportunities for residents to participate in the garden; and
  2. The Municipality of the District of Shelburne work with the Shelburne & Area Chamber of Commerce to publish a guide for subsistence gardening in Shelburne County as part of the job requirements for a JCP application being submitted by the Shelburne & Area Chamber of Commerce.

- MOTION CARRIED

Discussion was held regarding the Municipality supporting the Community Garden at SRHS along with the Chamber of Commerce, to avoid duplicating work and being responsible for the complete project. It was noted that there is no commitment to funding at this point but there will likely be a financial request for materials and supplies at a later date.

9. (d)

MOTION: DISCOVER SHELBURNE COUNTY TOURISM ASSOCIATION – FUNDING REQUEST

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Discover Shelburne County Tourism Association-Funding Request, which states that:

Council approve a payment in the amount of $1,275.66 to the Shelburne County Tourism Association to cover a proportionate share of the costs of participation in the Saltscapes Trade Show and a Shelburne County FAM Tour. Funds to come from grants to tourism account #0028340000.

-MOTION CARRIED

Deputy Warden Roscoe voted against this motion.

Discussion was held regarding advertising the area, participation and further funding.

9. (e)

MOTION: KIDS’ FAIR PLAY FUND – MARCH APPLICATION REVIEW

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Kids’ Fair Play FUNd – March Application Review, which states that:

Council approve the Kids’ Fair Play FUNd Application Review Committee Minutes of March 24, 2009.

-MOTION CARRIED

It was noted that during this review period eleven children were assisted in Shelburne County at a cost of $1,375.00.

9. (f)

MOTION: DISTRICT HEATING AND NET METERING

Being duly moved and seconded, be it resolved that Council accept the staff report regarding District Heating and Net Metering, which states that:

  1. The Municipality of the District of Shelburne direct staff to work with provincial and federal government agencies to secure funding for 80% of the total costs for a feasibility study for the geothermal district heating system and wind turbines for net metering to industrial park tenants and net billing for the municipality’s corporate operations; and
  2. The Municipality of the District of Shelburne commit to fund 20% of the total project costs for the feasibility study if funding can be secured for the balance of the project.

-MOTION CARRIED

Discussion was held regarding Council’s Goals and Objectives including development of renewable energy sources, funding options, support and retention of local businesses in the Industrial Park, using the ocean as a resource, windmills, as well as land ownership.

It was noted that a Wind Turbine By-Law will be discussed at the next Committee of the Whole Meeting.

8. PUBLIC HEARING:

(a) Amended Building By-Law #9

Second and Final Reading

MOTION: ENTER PUBLIC HEARING

Being duly moved and seconded, be it resolved that Council enter public hearing to discuss Amended Building By-Law #9.

-MOTION CARRIED

The Municipal Clerk advised that the changes to Building By-Law#9 were advertised in the local newspaper as required by the MGA. No comments were received from the public and no members of the public spoke to this issue at the meeting when invited by the Warden.

MOTION: EXIT PUBLIC HEARING

Being duly moved and seconded, be it resolved that Council exit public hearing.

-MOTION CARRIED

MOTION: AMENDED BUILDING BY-LAW#9

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne’s Building By-Law #9 be amended as recommended by the staff report of March 9, 2009.

-MOTION CARRIED

The Municipal Clerk commented on the process before the by-law can be finalized.

10. MEMBERS OF COUNCIL:

  1. Farmers Market – Councillor Holmes
  2. RCMP Advisory Board Merge – Councillor VanBuskirk
  3. Physician Recruitment – Warden Embree
  4. ICSP – Vision Statement Endorsement- Councillor Holmes

10. (a)

Councillor Holmes advised that there are two farmers markets opening for the warm season, in Sable River and one as well in the Town of Shelburne.

Discussion was held regarding opportunities for local businesses to be included, as well as becoming more self reliant and using local amenities.

10. (b)

MOTION: RCMP BOARD MERGE

BE IT RESOLVED that the Municipality of the District of Shelburne, upon recommendation from their RCMP Advisory Committee, agree to the creation of a single RCMP Advisory Committee by merging the Town of Shelburne, Town of Lockeport and the Municipality of Shelburne RCMP Advisory Committees.

-MOTION CARRIED

Deputy Warden Roscoe voted against this motion.

10. (c)

MOTION: PHYSICIAN RECRUITMENT COMMITTEE – LETTER OF SUPPORT

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne write a reply to the Physician Recruitment Committee Chairperson’s letter of March 24, 2009, stating:

  1. Continued support in principle for the physician recruitment committee development of a medical clinic;
  2. Funding be based on the proportion of population of the five municipal units in Shelburne County; and
  3. A staff report be prepared on funding to be provided only after further MDS consideration of the overall project, its costs and objectives.

-MOTION CARRIED

AMENDMENT: PHYSICIAN RECUITMENT COMMITTEE – LETTER OF SUPPORT

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne add the following as stipulation d. to the original motion:

The Municipality of the District of Shelburne favourably consider $6,200.00 for detail design of the medical clinic in the 2009/10 budget.

Councillor VanBuskirk voted against this motion.

Discussion was held regarding the overall project commitment as well as alternate funding options.

10. (d)

MOTION: ICSP VISION STATEMENT

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne endorse the Integrated Community Sustainability Plan Vision Statement as follows:

13. INFORMATION & OTHER REPORTS:

(a) Monthly Building Report – March, 2009
(b) Highway 103 Funding

13. (a)

The Monthly Building Report for March, 2009 was reviewed by Council.

13. (b)

Discussion was held regarding the Highway 103 funding announcement, and the request to aggressively monitor progress and implementation, as well as the cost and layout for the project to hopefully extend through to Sable River.

MOTION: HIGHWAY 103 FUNDING

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne write a letter to Premier Rodney MacDonald, Gerald Keddy, Brooke Taylor and Sterling Belliveau and the Chair of 103 Committee, thanking everyone for the provincial and federal commitment for upgrades to Highway 103, Port Mouton, and asking to be kept updated on progress of the project.

-MOTION CARRIED

14. ADDED ITEMS:

  1. Municipal Building Emergency Renovations - Discussion was held regarding the need for emergency repairs to the Municipal Building from an extensive water leak in the Lock-Up Facility. The Fire Chief, Building Superintendant and Joint Services Board Administrator decided to shut down the lock-up operations until the repairs were made to avoid any public safety concerns and hazards to tenants.

MOTION: MUNICIPAL BUILDING EMERGENCY RENOVATIONS

Being duly moved and seconded, be it resolved that Council approve an expenditure of $12,000.00 for emergency renovations to the Municipal Building.

-MOTION CARRIED

It was noted that there will be additional costs to be determined at a later date to completely rectify this situation.

Being duly moved and seconded, be it resolved that there being no further business, the meeting be adjourned at 6:40 pm.
