REGULAR SESSION OF THE 49TH COUNCIL

OF THE

MUNICIPALITY OF THE DISTRICT OF SHELBURNE

January 26, 2009

The Regular Session of the 49th Council of the Municipality of the District of Shelburne was held on Monday, January 26, 2009 commencing at 5:00 p.m. in the Council Chambers of the Municipal Administration Building, Shelburne, Nova Scotia.

1. CALL TO ORDER:

The Regular Session of Council was called to order at 5:00 p.m.

Deputy Warden Roscoe chaired this meeting.

2. BLESSING:

Councillor Norman Wallet led Council in repeating the Lord's Prayer.

3. PROCLAMATIONS:

(a) National Flag Day – February 15, 2009

4. APPROVAL OF MINUTES - January 7, 2009

Being duly moved and seconded, be it resolved that the Council Minutes of January 7, 2009 be approved as circulated.

-MOTION CARRIED

5. APPROVAL OF AGENDA

Being duly moved and seconded, be it resolved that the Council Agenda of January 26, 2009 be approved with the following additions:

  • Shelburne County Arts Council
  • Physician Recruitment Letter

-MOTION CARRIED

8. PUBLIC HEARING:

9. STAFF REPORTS:

(a) Grants – Museums and Tourism Organizations
(b) District Newsletters

9(a) MOTION: MUSEUM AND TOURISM GRANTS

Being duly moved and seconded, be it resolved that on a recommendation of Committee of the Whole, Council accept the staff report regarding Museum and Tourism Grants, which states that:

The following allocations be approved for grants to tourism organizations and museums:

  • Destination Southwest Nova Association - $3426.00
  • Town of Shelburne Visitor Information Centre - $2500.00
  • Shelburne Museum Complex - $3218.00
  • Black Loyalist Heritage Society - $6350.00

-MOTION CARRIED

9. (b) MOTION: DISTRICT NEWSLETTERS

Being duly moved and seconded, be it resolved that on a recommendation of Committee of the Whole, Council accept the staff report regarding District Newsletters, which states that:

The distribution of District Newsletters be prohibited from the period beginning on nomination day and ending on the day of the swearing in of the new Council.

-MOTION CARRIED

Discussion was held regarding the use of Municipal materials during campaigning as well as the possibility of preparing a municipal wide newsletter to be included with the tax bills. This matter will be discussed at a future meeting.

10. MEMBERS OF COUNCIL:

Re: Welshtown Road Paving – Councillor Holmes

10. (a) MOTION: STREETLIGHT REQUEST

Being duly moved and seconded and on a recommendation of Committee of the Whole;

Whereas the RCMP have had complaints of vandalism in front of 128 Shore Rd, West Green Harbour; and

Whereas a streetlight would discourage vandals from loitering in the area; and

Whereas there are three streetlights on consecutive poles on Slipway Rd, West Green Harbour;

Therefore be it resolved that a staff report be prepared to evaluate the feasibility of the second streetlight on Slipway Rd. to be relocated to 128 Shore Road, West Green Harbour.

-MOTION CARRIED

Discussion was held regarding vandalism and the current moratorium on streetlights.

Warden Embree arrived at 5:10 pm and joined the meeting.

10. (b) MOTION: STATEMENT OF POLICY DISTRICT GRANT FUND

Being duly moved and seconded and on a recommendation of Committee of the Whole;

Whereas Council during its annual budget deliberations each year determines an allocation of funds known as the District Grant Fund; and

Whereas the Councillor for each district has the authority to spend the funds allocated to his/her district on projects requiring assistance in their area as described in the Disbursement Policy of the District Grant Fund; and

Whereas it may appear to be inappropriate to be disbursing these monies just prior to, during, or immediately following a municipal election;

Therefore be it resolved that a staff report be prepared to evaluate the option that monies from the District Grant Fund shall not be approved or disbursed starting from 60 days prior to a municipal election and shall not resume until the new Council is sworn in following that election.

-MOTION CARRIED

Discussion was held regarding the staff report including use of emergency funds, using the same timeframe as noted for district newsletters and referencing the Municipal Elections Act.

10. (c) MOTION: CODE OF CONDUCT

Being duly moved and seconded and on a recommendation of Committee of the Whole, be it resolved that the Municipality of the District of Shelburne adopt the UNSM Code of Conduct for Municipal Elected Officials and sign upon acceptance.

-MOTION CARRIED

Councillors signed the Code of Conduct, witnessed by the Chief Administrative Officer.

10. (d) MOTION: LETTER TO DEPARTMENT OF TRANSPORTATION

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne write a letter to the Minister of the Department of Transportation and Infrastructure Renewal, requesting repaving of the Welshtown Road (7.5 kms) as well as other roads in the Municipality.

-MOTION CARRIED

Discussion was held regarding possible infrastructure funding and correspondence regarding repairs and maintenance vs. large projects. It was noted that a Highway 103, Granite Village staff report will be presented at a future meeting.

(a) Monthly Building Report – December, 2008

13.(a)

The Monthly Building Report for December, 2008 was reviewed by Council.

14. ADDED ITEMS:

(a) Shelburne County Arts Council
(b) Physician Recruitment Letter

14. (a)

It was noted that the Shelburne County Arts Council is looking for a workspace . Any suggestions for available office space should be directed to Rebecca Tudor. It was noted that the Shelburne County Arts Council is an active and engaged organization in the community.

14. (b)

It was noted that a letter was received from the Physician Recruitment Committee but no response is required at this time. Discussion was held regarding future support, status of the project definition and upcoming studies as well as the realignment of health authority districts.

Being duly moved and seconded, be it resolved that there being no further business, the meeting be adjourned at 5:37 pm.
