REGULAR SESSION OF THE 49TH COUNCIL

OF THE

MUNICIPALITY OF THE DISTRICT OF SHELBURNE

February 22, 2010

The Regular Session of the 49th Council of the Municipality of the District of Shelburne was held on Monday, February 22, 2010 commencing at 5:00 p.m. in the Council Chambers of the Municipal Administration Building, Shelburne, Nova Scotia.

1. CALL TO ORDER:

The Regular Session of Council was called to order at 5:00 p.m.

2. BLESSING:

Councillor Wallet led Council in repeating the Lord's Prayer.

4. APPROVAL OF MINUTES January 25, 2010

Being duly moved and seconded, be it resolved that the Council Minutes of January 25, 2010 be approved as circulated.

5. APPROVAL OF AGENDA

Being duly moved and seconded, be it resolved that the Council Agenda of February 22, 2010 be approved with the following additions:

9. (a)

MOTION: ADOPTION OF THE INTEGRATED COMMUNITY SUSTAINABILITY PLAN

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Adoption of the Integrated Community Sustainability Plan which states that:

The Municipality of the District of Shelburne adopt the final version of the Integrated Community Sustainability Plan, dated February 1, 2010, and commit to adhere to the principles and goals described within the plan and to undertake to implement its actions.

-MOTION CARRIED

Discussion was held regarding staff’s hard work on this project and its ongoing need for support during implementation.

9. (b)

MOTION: EASTERN SHELBURNE COUNTY ENERGY STRATEGY CONTRACTOR SELECTION

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Eastern Shelburne County Energy Strategy Contractor Selection, which states that:

The Municipality of the District of Shelburne award the contract for the Eastern Shelburne County Energy Strategy to Dillon Consulting Ltd., if funding is confirmed through the FCM Green Municipal Fund and if the Town of Shelburne and the Town of Lockeport Councils support this decision.

-MOTION CARRIED

It was noted that funding as well as the Towns support should be confirmed within the next few weeks.

9. (c)

MOTION: APPOINTMENT OF CERTIFIED BULDING INSPECTOR – ANDREW GOREHAM

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Appointment of Certified Building Inspector, which states that:

Council appoint Mr. Andrew Goreham as Certified Building and Fire Inspector for the Municipality of the District of Shelburne.

9. (d)

MOTION: REGIONAL ECONOMIC DEVELOPMENT

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Regional Economic Development, which states that:

It is recommended that the Municipality of Shelburne not join the economic development authority being proposed by SWSDA

Discussion was held regarding funding options for continuing programs.

9. (e)

MOTION: EMERGENCY MANAGEMENT RESPONSE BY-LAW E-200

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Emergency Management Response By-Law E-200, which states that:

The Council of the Municipality of the District of Shelburne give first reading to the attached Emergency Management Response By-Law E-200; and

The Municipality advertise Council’s intent to give the said by-law second and final reading at its meeting of Monday, March 22, 2010, at 5:30 pm.

It was noted that the EMO Ad-Hoc Committee discussed this by-law at its last meeting with no concerns.

9. (f)

MOTION: SHELBURNE COUNTY EAST RCMP ADVISORY BOARD BY-LAW R-100

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Shelburne County East RCMP Advisory Board By-Law R-100, which states that:

The Council of the Municipality of the District of Shelburne give first reading to the attached Shelburne County East RCMP Advisory Board By-Law R-100; and

The Municipality advertise Council’s intent to give the said by-law second and final reading at its meeting of Monday, March 22, 2010, at 5:45 pm.

-MOTION CARRIED

The Clerk advised of minor changes to the by-law and noted that the updated version has been forwarded to the Towns of Shelburne and Lockeport for their Council approval as well.

9. (g)

MOTION: REPEAL BY-LAW R-200

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Repeal By-Law R-200, which states that:

The Council of the Municipality of the District of Shelburne give first reading to the attached Repeal By-Law R-200; and

The Municipality advertise Council’s intent to give the said by-law second and final reading at its meeting of Monday, March 22, 2010, at 5:15 pm.

It was noted that the draft Tax Exemption Policy will be brought forward at the March Committee of the Whole Meeting.

9. (h)

MOTION: TRI-COUNTY HOUSING AUTHORITY BOARD – RE-APPOINTMENT

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Tri-County Housing Authority Board – Re-Appointment, which states that:

Council approve the re-appointment of Henry (Hank) Falk as the Municipality of the District of Shelburne’s representative on the Tri-County Housing Authority Board.

9. (i)

MOTION: PRIVATE ROAD NAME APPROVAL – SANDY POINT

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Private Road Name Approval – Sandy Point, which states that:

Council approve the naming of a private lane within the community of Sandy Point as Higgens Lane, Sandy Point.

-MOTION CARRIED

It was confirmed that since the lane is new, new civic numbers will be given to the residents of Higgens Lane.

9. (j)

MOTION: SHELBURNE COUNTY VOLUNTEER SERVICES COORDINATOR

Being duly moved and seconded, be it resolved that Council accept the staff report regarding Shelburne County Volunteer Services Coordinator, which states that:

Council support the funding of a Volunteer Services Coordinator position with a contribution in the amount of $3,035.00 for the year 2010/11.

-MOTION CARRIED

Discussion was held regarding funding of this position, office space, advertising for this position, projects and duties, as well as enhancement of the position description.

It was agreed that a presentation be scheduled with the Co-ordinator to discuss this program.

10. (a)

Deputy Warden Roscoe advised Council that he has heard there may be discussions of closing various Crown Attorney Offices in Nova Scotia, including the Shelburne Office. Discussion was held regarding potential loss of RCMP resources and time, if this were to take place.

MOTION: NOVA SCOTIA CROWN ATTORNEY OFFICES - PRESENTATION

Being duly moved and seconded, be it resolved that Council invite a representative from the Nova Scotia Crown Attorney Office to attend a Council meeting to discuss continued availability of services for our local office, as well as write a letter to the Minister of Justice.

10. (b)

Councillor Holmes updated Council on the Population Forum Conference she attended on February 9, 2010 regarding the shrinking population in Nova Scotia and the negative effects it is having on our communities. Discussion was held regarding the need for funding to retain as well as recruit workers.

10. (c)

Discussion was held regarding correspondence sent to Environment Canada requesting support for a Doppler Weather Radar Station for Southwestern Nova Scotia which will provide a much needed service to our large commercial fishing and recreational industries.

It was suggested that surrounding municipal units be requested to send similar letters to Environment Canada and the Minister of Environment; no action was taken.

MOTION: METEOROLOGICAL SERVICE OF CANADA - PRESENTATION

Being duly moved and seconded, be it resolved that Council invite Bill Appleby, with the Meteorological Service of Canada, Atlantic Region Representative, to Committee of the Whole to make a presentation regarding the state of the meteorological service in Southwestern Nova Scotia.

(a) Monthly Building Reports– January 2010

The January report was reviewed with discussion regarding construction value figures reflecting assessment values.

14. (a)

Deputy Warden Roscoe suggested that Councillor Holmes, as Council’s representative on the Library Board, look into the possibility of the libraries internet funding being cut and report back to Council.

14. (b)

Deputy Warden Roscoe noted that Finance Meetings have been held by the NDP government to involve the public in coming up with ideas to reduce provincial debt, but none were scheduled for Shelburne County.

MOTION: PROVINCIAL FUNDING DEFICIT- MEETING REQUEST

Being duly moved and seconded, be it resolved that Council write a letter to Minister Belliveau requesting a meeting in Shelburne County regarding provincial debt reduction.

14. (c)

Councillor Townsend advised Council that the Team Shelburne funds are in the bank in Clarks Harbour and that she will provide further information after Wednesday’s meeting. A breakdown of SWSDA’s liabilities was requested, also it is anticipated that the Ombudsman Report will be available for Councillors’ viewing this week.
