REGULAR SESSION OF THE 49TH COUNCIL

OF THE

MUNICIPALITY OF THE DISTRICT OF SHELBURNE

September 23, 2009

The Regular Session of the 49th Council of the Municipality of the District of Shelburne was held on Monday, September 23, 2009 commencing at 5:00 p.m. in the Council Chambers of the Municipal Administration Building, Shelburne, Nova Scotia.

1. CALL TO ORDER:

The Regular Session of Council was called to order at 5:00 p.m.

2. BLESSING:

Councillor Cathy Holmes led Council in repeating the Lord's Prayer.

3. PROCLAMATIONS:

None

4. APPROVAL OF MINUTES - July 27, 2009

Being duly moved and seconded, be it resolved that the Council Minutes of July 27, 2009 be approved as circulated.

-MOTION CARRIED

5. APPROVAL OF AGENDA

Being duly moved and seconded, be it resolved that the Council Agenda of September 23, 2009 be approved with the following additions:

  • Item 14(a), Physician Recruitment & Visit , moved to item 9(e)
  • Item 14(b), UNSM Conference – Attendance, moved to item 14(a)
  • Support Our Troops Softball Tournament – Information only, 14(b)

9. (a)

MOTION: Museum and Tourism Grants

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Museum and Tourism grants which states that:

It is recommended that the following allocations be approved for Grants to Tourism Organizations and useums (S22 – Museums and Tourism):

  • Destination Southwest Nova Association - $3426
  • Town of Shelburne Visitor Information Centre - $2500
  • Clyde River Motocross Park - $1500
  • Historic Shelburne Tall Ships Society - $479

9. (b)

MOTION: APPOINTMENT OF BUILDING/FIRE INSPECTORS – GLEN MUISE, BRENT HASSE, and MICHAEL BEVIS

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding the appointment of building inspectors – Glen Muise, Brent Hasse, and Michael Bevis, which states that:

It is recommended that Council appoint Mr. Glen Muise, Brent Hasse and Michael Bevis as Building and Fire Inspectors for the Municipality of Shelburne.

-MOTION CARRIED

The CAO stated that the current Building Inspector for the Municipality of Shelburne will be taking a 3-month leave of absence beginning September 24, 2009. Calls will be made to the Municipality of Argyle, Municipality of Yarmouth and the Town of Yarmouth to see if they may be able to accommodate the Joint Services Board by their inspectors assisting in the Inspection Office, when needed. There will be other Inspectors appointed at a later date.

9. (c)

MOTION: APPOINTMENTS TO BOARDS AND COMMITTEES – 2009/10

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, Council accept the staff report regarding Appointments to Boards and Committees – 2009/10 which states that:

  1. Council adopt the attached List of Boards and Committees for 2009/10 as amended; and
  2. Council review the List of Boards and Committees in February, 2010 with a view to adopting the List of Boards and Committees for 2010/11, effective April 1, 2010.

It was noted that on the bottom of page four the word “Standing” should be changed to “Advisory”.

9. (d)

Physician Recruitment - The CAO gave an update on Physician Recruitment. He is currently looking at examples in other areas in the Province that have similar needs to Shelburne and have had success recruiting Physicians without the monetary incentives. It was suggested that perhaps Council should meet with the DHA to discuss the inequities. Council agreed that they need to get the DHA involved and move this project forward.

MOTION: PHYSICIAN RECRUITMENT

Being duly moved and seconded, be it resolved that the Municipality of the District of Shelburne contact Bob Legere, Chair of the Physician Recruitment Committee, and advise him that the Municipality is interested in discussions regarding Dr. Charles Wambulwa.

9. (e)

MOTION: KIDS FAIR PLAY FUNd – APPLICATION REVIEW

Being duly moved and seconded, be it resolved that Council accept the staff report regarding the Kids Fair Play FUNd Application Review, which states that:

It is recommended that Council approve the Kids’ Fair Play FUNd Application Review Minutes of September 16, 2009 (attached).

There was discussion in regards to the financial stability of the FUNd. The Director of Recreation & Parks stated that province wide; there is a high demand for this type of assistance. There have recently been two groups that have hosted a fundraiser for the FUNd which have raised over $2,200.00.

9. (f)

INFORMATION ONLY: H1N1 (HUMAN SWINE INFLUENZA)

The CAO gave a brief update regarding H1N1. The Municipality is working hard at making staff aware and educated on this matter. Cross-training has taken place with temporary staff so that essential services will continue to be provided in the event of a breakout. A question was raised about the possibility of providing a flu shot for employees; this matter will be investigated.

9. (g)

INFORMATION ONLY: TAX SALE

The Director of Finance gave a brief summary of his report. Overall, he was pleased with how well the process went, noting that it was a learning experience for all staff. He suggested that in the future, the Municipality should consider purchasing properties that do not sell at the tax sale. By doing this, the Municipality could then sell the properties through a tendering process. The Director of Finance was requested to make a list of the sold properties and their selling price, as well as properties that did not sell. He will put this information in the Councillors’ mailboxes.

10. (a) MOTION: MUNICIPAL PARTNERSHIPS

Being duly moved and seconded, be it resolved that on the recommendation of the Committee of the Whole, the Municipality of the District of Shelburne invite the Towns of Shelburne and Lockeport to investigate the benefits and disadvantages of amalgamating the three municipal units in eastern Shelburne County.
-MOTION CARRIED

The CAO will prepare a Staff Report, outlining the steps to take in moving ahead with this matter and will present it at the next Committee of the Whole meeting.

14. (a)

The UNSM Annual Conference will be held November 4-7, 2009 at the Weston in Halifax. There will be a Professional Development Session included in the conference. Attendance is encouraged. Rooms will be booked for anyone interested.

14. (b)

A Support the Troops Softball Tournament will be hosted in Shelburne at the Roger Grovestine Complex on September 27-29, 2009. There are 13 teams registered.

14. (c)

The Warden stated that he has been in contact with the management at Shelburne Ship Repair. Negotiations are underway and hopefully there will be a positive conclusion to these negotiations in the near future.

14. (d)

The Warden stated that he has been in contact with the NS Department of Transportation & Public Works concerning the Highway #103 project. This project is still in the early stages. The land exchange for the straightening of the corner at Granite Village has been completed.
